Former NUBE sec-gen jailed 10 years for CBT

KUALA LUMPUR: Former NUBE secretary-general K. Shanmugam was jailed 10 years and fined RM20,000 by a Sessions Court here on Wednesday for criminal breach of trust involving union funds totalling RM8mil.

Shanmugam, 63, was charged with committing CBT for purchasing shares on a contra basis, which was in violation of a NUBE resolution dated Oct 21, 1994.

He was said to have committed the offence at the union’s office in Jalan Tunku Abdul Rahman in 1996.

In her oral judgment, Sessions Court judge Azizah Mahamud said the fact that Shanmugam was entrusted with the union’s fund totalling RM8.8mil was proven through three prosecution witnesses.

She also told Shanmugam that she would only allow a stay of his jail term.

Azizah increased his bail from RM50,000 to RM100,000 pending disposal of his appeal.

The judge impounded his international passport and ordered him to file his notice of appeal by Thursday.

Pleading for leniency, counsel R.Shankar said his client was a first-time offender.

“The accused did not have any personal gain. Please consider that the accused, as the NUBE secretary-general, had played a big role in the country’s economy,” he said.
